Symposium in Boston April 10, 2011
In April 2011, Attorney Alan Shapiro attended a symposium in Boston Massachusetts which was sponsored by the American Bar Association, Workers Injury Law and Advocacy group (WILG), and the Massachusetts Academy of trial attorneys. The symposium was titled “Workers’ Compensation: a Centennial History and the Future”.

In April 2011, Attorney Alan Shapiro attended a symposium in Boston Massachusetts which was sponsored by the American Bar Association, Workers Injury Law and Advocacy group (WILG), and the Massachusetts Academy of trial attorneys. The symposium was titled “Workers’ Compensation: a Centennial History and the Future”. Some of the subjects discussed were:
1. The interplay of Workers’ Compensation, the Americans with Disability Act, and the Family Medical Leave Act.
2. Medicare Set Asides
3. Compensation laws such as the Defense Base Act and its effect on Foreign Nationals.
Medicare Set Aside Update:
Medicare set asides and provisional payments do not apply to Federal Workers’ Compensation cases because a Federal Workers’ Compensation case can not be settled. However, Medicare set asides and provisional payments do apply to Longshore, Defense Base Act, and Non Appropriated Funds cases. Medicare unfortunately has a significant interest in any settlement. Their interest must be considered when negotiating a settlement of a claim. Medical still has a legal interest in the settlement amount even if the claimant is not receiving Social Security or Medicare, but has a reasonable expectation of receiving benefits within thirty months.
