Aggravation of Non-work related pre-existing condition


When a pre-existing condition becomes disabling because of a work related incident, the resulting disability is compensable regardless of the degree of such aggravation.

When a pre-existing condition becomes disabling because of a work related incident, the resulting disability is compensable regardless of the degree of such aggravation.  Any worsening of the pre-existing condition by the employment injury provides the basis for benefits.

Pre-existing conditions and a scheduled award.

In determining entitlement to a scheduled award, pre-existing impairment to the scheduled member is to be included.  OWCP is not to apportion an impairment rating between pre-existing conditions and a work related injury.
