Causal Relationship and “magic words” in Federal Workers' Comp Cases


Words are important.  Words such as: “can”, “could”, “more likely”, “in my medical opinion”, are not sufficient to establish causal relationship.

Words are important.  Words such as: “can”, “could”, “more likely”, “in my medical opinion”, are not sufficient to establish causal relationship.  The physician must express his/her opinion in terms of direct or proximate relationship.  The physician must explain how the injury produced the change in the body.  The physician needs to explain the mechanical process.
